PCI Scope Wizard – Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Datatel PCI Scope Wizard (the “Wizard”).
The Wizard is provided by Datatel Inc. and Datatel Communications Inc. (“Datatel,” “we,” “us,” or “our”).
By accessing or using the Wizard, you acknowledge that you have read, understood, and agree to be bound by these Terms and Datatel’s Privacy Policy.
Educational Purpose Only
The PCI Scope Wizard is provided solely for informational and educational purposes.
The Wizard:
- Is not a PCI assessment, audit, certification, validation, or professional evaluation.
- Does not provide legal, compliance, technical, security, PCI, or professional advice.
- Is intended to help users learn about general PCI DSS concepts and terminology only.
You acknowledge and agree that you will not rely on the Wizard or its outputs as a substitute for professional advice, independent analysis, or regulatory guidance.
No Warranties
The Wizard and all outputs are provided “AS IS” and “AS AVAILABLE.”
Datatel:
- Makes no representations or warranties regarding accuracy, completeness, timeliness, or suitability.
- Does not warrant that outputs are current, error‑free, or applicable to any specific environment.
- Expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, or non‑infringement.
Limitation of Liability
To the maximum extent permitted by law:
- Datatel shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Wizard.
- This includes damages for reliance, inaccurate interpretation, business decisions, compliance failures, or scope determinations.
- Datatel’s total aggregate liability, if any, shall be limited to USD $0, or at Datatel’s option, re‑provision of access to the free Wizard.
No Client, Advisory, or Fiduciary Relationship
Use of the Wizard does not create:
- An attorney-client relationship
- A consultant-client relationship
- A fiduciary relationship
- A Qualified Security Assessor (QSA) engagement
- Any professional services or contractual relationship
Any professional, advisory, or compliance services offered by Datatel are governed solely by separate written agreements, including applicable Order Forms and Master Service Agreements.
Required Follow-up Educational Communications
The PCI Scope Wizard is provided as a two-part educational experience, which includes:
- Delivery of educational Wizard outputs; and
- Required follow-up educational communications designed to help users understand the PCI concepts referenced in those results
By using the Wizard, you acknowledge and agree that:
- These follow-up‑ communications are a core component of the service.
- They are required and not optional.
- They are educational only and do not constitute professional advice.
Allowable References and User‑Initiated Requests
During educational communications:
- Datatel may reference its services or solutions in a non‑promotional, informational context
- Datatel will not send general marketing or promotional communications unless you separately request or consent to them
- If you initiate a request for additional information, services, or assistance, Datatel may respond accordingly
Intellectual Property Rights
All right, title, and interest in and to the Wizard, including its content, structure, logic, outputs, and materials are owned by Datatel and protected by intellectual property laws.
You may use Wizard outputs solely for your internal educational purposes.
You may not copy, publish, distribute, reverse engineer, commercialize, or create derivative works from the Wizard or its outputs without Datatel’s prior written consent.
Modification or Termination
Datatel may modify, suspend, or discontinue the Wizard or these Terms at any time without notice.
Continued use of the Wizard after changes constitutes acceptance of the updated Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict law principles.
